Terms of Service

Plain English: PILK is a tool that helps you stay in touch with people. You're responsible for what you send. Don't use PILK to spam, deceive, or harass anyone. We provide PILK "as is" and reserve the right to update these terms.

1. Acceptance of these terms

By installing, accessing, or using PILK ("the Service"), you agree to these Terms of Service. If you don't agree, don't use PILK.

2. Description of the Service

PILK is an AI-powered personal relationship assistant. It reads messages from channels you connect (such as iMessage, Instagram, Facebook Messenger, Telegram, WhatsApp, Email, and X), identifies people you may want to reach out to, and generates draft messages in your writing voice. PILK runs locally on your computer and only sends messages with your explicit approval.

You remain solely responsible for every message you send through PILK. PILK drafts; you decide.

5. Third-party platforms

PILK connects to third-party platforms (Meta, Telegram, Twilio, Anthropic, etc.) via their public APIs. Your use of those platforms through PILK is also subject to their own terms of service. PILK is not responsible for changes those platforms make to their APIs, policies, or message rate limits.

6. AI-generated content

PILK uses large language models (currently Anthropic's Claude) to draft message content. AI-generated content may sometimes be inaccurate, awkward, or inappropriate for the context. You are responsible for reviewing every draft before sending. PILK is not liable for messages you choose to send.

7. Intellectual property

PILK's software, design, and documentation are the property of Aaron Pilkington. You receive a non-exclusive, non-transferable license to use PILK on your own devices for personal use. You may not redistribute, resell, or sublicense PILK without written permission.

8. Privacy

Our handling of your data is described in the Privacy Policy, which is incorporated by reference into these Terms.

9. Disclaimer of warranties

PILK IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that PILK will be uninterrupted, error-free, or that defects will be corrected. You use PILK at your own risk.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AARON PILKINGTON AND THE PILK PROJECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR DAMAGE TO RELATIONSHIPS — ARISING FROM YOUR USE OF PILK. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID PILK IN THE PRECEDING 12 MONTHS.

11. Termination

You may stop using PILK at any time by uninstalling it. We may suspend or terminate your access if you breach these Terms. On termination, you must stop using PILK and may delete all local data (see Data Deletion).

12. Changes to these terms

We may update these Terms from time to time. If we make material changes we will post a notice on this page and update the "Last updated" date. Continued use of PILK after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of laws provisions. Any dispute arising out of these Terms will be resolved in the state or federal courts located in Pinellas County, Florida.
